DIY South African national phase instruction

Step 1: Login and select "New Cases" > "South Africa" > "Patent" > "National Phase" in the navigation bar on the left side.

Step 2: Complete the online application form; download forms for signature; upload scanned copies of the signed forms; and pay by credit card

1. PCT Details

Amendments

On filing, the specification must mirror the PCT application on file at WIPO.

Changes thereto (including changes to applicant details) may only be made after filing.

Notes: If you are unsure regarding completion of the online application form, select "Submit for review" (cost $49). A registered South African patent attorney will review your inputs and ensure that the application is in order before filing the application with the South African Patent Office.

Next steps:

  • Upon payment (or, review (if selected)), we will immediately file the South African national phase patent application.
  • We will send you an application number and filing receipt within two business days, and you can track the status of the application online.
  • Within 9 months, we should send you an email reporting acceptance of the patent application. You will need to respond to this email and instruct us to publish acceptance (cost: $70 payable by credit card).
  • We typically receive the patent registration certificate within 3 months of publication. An electronic copy of the registration certificate will be emailed to you without charge, and you can (optionally) request the document to be couriered to you (cost: $110 payable by credit card).

Note: Filing and official fees are included in our filing fee. Downstream costs: Publication ($70); Courier ($110, optional); and Renewals.

Traditional South African national phase instruction

Step 1: Login and select "New Cases" > "South Africa" > "Patent" > "Attorney Prepared National Phase" in the navigation bar on the left side.

Step 2: Insert your reference and the PCT number

Step 3: Click "Proceed to filing" and pay by credit card

Next steps:

  • Your South African national phase patent application will be prepared by a South African patent attorney.
  • Declaration Forms and a Power of Attorney will be emailed to you for signature. We require a scanned copy of the signed forms to be emailed to us. No commissioning or legalisation is required.
  • Upon receipt of the signed documents, we will file the South African national phase patent application.
  • We will send you an application number and filing receipt within two business days, and you can track the status of the application online.
  • The South African national phase patent application should be accepted within 9 months, where after we will arrange publication (i.e. grant).
  • We typically receive the patent registration certificate within 3 months of publication, which we will courier to you.

Note: Filing, official fees, publication (i.e. grant) and courier costs are included in our filing fee. There are no further costs (apart from Renewal costs).
